Empanelment Conditions At TLCEODRI / Empanel As An ODR Expert At TLCEODRI

Perry4Law Organisation (P4LO) has been working in the field of Online Dispute Resolution (ODR) since 2005. We started at a time when ODR was in its infacy stage even in foreign jurisdictions. With more than a decade old journey, P4LO has reached at a stage where it has become a market leader in ODR for national and international stakeholders. Nevertheless, ODR is still at infancy stage in India even in December 2016.

P4LO hopes that ODR would see growth in India in 2017 and our Techno Legal Centre Of Excellence For Online Dispute Resolution (ODR) In India (TLCEODRI) would play a crucial role in this regard. For those interested in getting Techno Legal Training for ODR in India and other jurisdictions, P4LO has launched a dedicated blog. We would keep on sharing operational and technical aspects of ODR on that blog so that stakeholders at large can be benefitted.

Further, Perry4Law's Techno Legal Base (PTLB) has been imparting techno legal trainings in various fields for long and a specialised online course and training for ODR would be launched very soon. Our aim is to build a techno legal workforce of ODR experts so that workload on Indian courts can be minimised.

Interested ODR stakeholders may seek "Empanellment at TLCEODRI" by choosing the help topic "Empanellment As ODR Expert" from the drop down menu of the website. Interested ODR stakeholders can also see the "Empanelment Conditions" mentioned at PTLB's website. We would provide ODR specific forms for empanelment at TLCEODRI very soon. Till then people interested in empanelling as ODR experts at TLCEODRI can either use the old forms or generate a ticket from the help section of the website.

Empanelment at PTLB and TLCEODRI can be requested by Individuals, Firms, Law Firms, Companies, LLPs, CA Firms, CS Firms, Knowledge Centres, Knowledge Institutes, etc. Individuals include lawyers, professionals, self-employed professionals, executives at Companies, etc. There is no limitation as to “Nationality” or “Residence” and Individuals/Firms/Institutions/Companies resident in other countries can also empanell with us.

We reserve the “Absolute Discretion” to accept and reject any empanelment request without any reason and intimation. We would neither be responsible nor entertain empanelment requests that are not “approved by us in advance”.

Further, you must dispatch/post your Cheques/DD/Cash at your own risks and in no case P4LO or its employees or Partners would be responsible for any loss or theft of such Cheques/DD/Cash. Cheques must be made in favour of "Perry4Law" and must be account payee only. Name and mobile number of the sender(s) must be given at back of the cheque/DD in all cases. Any request for empanellment would be entertained only once the Cheque/DD is "Realised" in our favour.

A list of empanelled Individuals/Firms/Companies/Institutions would be publicly maintained by TLCEODRI at its Website or Blog(s). This list would contain the basic details of the empanelled Individuals/Firms/Companies/Institutions with their latest “Contact Details”. This way stakeholders seeking services of TLCEODRI could choose from the list of empanelled experts of their choice, if they desire so. Further, services of those empanelled would also be taken by TLCEODRI on “Preference Basis”.

Those empanelled at TLCEODRI would be accorded a "Seniority" as per the date of their enrollment. Naturally, those enrolled first would be given "Preference" for ODR assignments as compared to those enrolling latter in case there is a tie between two ODR experts. The empanellment would be for minimum of one year (1) and maximum of five (5) years. The empanelment may be renewed at the discretion of TLCEODRI.

For Individuals, the “Empanelment Fees” include one time non-refundable registration fee of Rs. 10,000 (Ten Thousands) plus Rs. 5,000 (Five Thousand) per year. For instance, if an Individual wishes to be empanelled at TLCEODRI for one year, he must pay Rs. 15,000 (Fifteen Thousand). For two years he must pay Rs. 20,000 (Twenty Thousand) and so on.

For Firms, Companies, Institutions, etc the “Empanelment Fees” include one time non-refundable registration fee of Rs. 10,000 (Ten Thousands) plus Rs. 10,000 (Ten Thousand) per year. For instance, if a Firm wishes to be empanelled at TLCEODRI for one year, it must pay Rs. 20,000 (Twenty Thousand). For two years it must pay Rs. 30,000 (Thirty Thousand) and so on.

We accept Cheques, DD, Cash, Electronic Transfer (Bank), etc for paying empanelment fees. We expect risk free, complete and absolute payment towards empanelment fees. In no case, TLCEODRI would be responsible for loss of Cheques, DD, Cash, Electronic Money Transfer, etc. These payments must be made by the applicant at his/its own risk.

Finally, be aware of the “Phishing Attacks”. TLCEODRI or any of its Segments, Associates, Partners, etc would not solicit empanelment through e-mails or telephone calls except through this platform. To avoid financial loss and frauds, kindly check any such electronic communication or telephone calls thoroughly and send us an e-mail if you come across any such dubious, suspicious or fraudulent communication.

We do not entertain any query or request regarding the abovementioned issues except through this platform and after following this procedure. Further, the terms and conditions mentioned herein are very strict and only in exceptional case we deviate from them. TLCEODRI reserves the “Absolute Discretion” regarding the abovementioned aspects and the decision of TLCEODRI would be “Conclusive and Final” in all cases.

You hereby agree to these terms and conditions while applying for "Empanelment" or for our course, training, internships, etc.

E-commerce is growing at a fast speed in India as India is seen as a lucrative and profitable market for e-commerce business. However, e-commerce laws in India are still not clear to most of the e-commerce entrepreneurs. As a result most of the e-commerce websites are not following the laws of India and are inadvertently violating the laws of India. Regulatory authorities of India have started questioning the operations of e-commerce websites of India and many of them are facing potential legal actions.

The tussle is not merely between the regulatory authorities and e-commerce website owners but it also extends to disputes between e-commerce websites and their consumers. Most of the consumers are not aware about their digital rights while dealing with such e-commerce companies and websites. At the same time there is lack of forums and dispute resolutions platforms for digital consumers in India where they can agitate their claims. In short, e-commerce dispute resolution in India is still to be managed by Indian Government.

We at Perry4Law Organisation (P4LO) believe that online dispute resolution (ODR) can be effectively used in India to manage many digital and non digital disputes, including for e-commerce purposes. To make ODR a success in India, Techno Legal Centre of Excellence for Online Dispute Resolution (ODR) in India (TLCEODRI) has been providing its techno legal ODR services to national and international stakeholders.

TLCEODRI has realised that ODR in India has failed to materialised due to lack of techno legal expertise on the one hand and absence of public awareness on the other. This is the reason why we have started an online dispute resolution (ODR) platform in India for national and international stakeholders where techno legal disputes can be resolved in an online environment.

This platform has twin objectives to meet. The first is to develop techno legal skills and trainings for ODR in India and abroad. This objective is fulfilled through the initiative titled ODR Trainings and Skills Development in India by TLCEODRI. The second objective is to spread public awareness about ODR in India and abroad. Through this thread we wish to share about the ODR methods that would be used by TLCEODRI. These methods are neither exclusive nor exhaustive and many more methods and online dispute resolution mechanisms (ODRM) are there in place. 

The methods/mechanisms proposed to be used by TLCEODRI are as follow:

(1) E-mail communications,

(2) Web and mobile chats,

(3) Discussion forums,

(4) Dedicated customer relationship management platform(s),

(5) dedicated social media platforms,

(6) ODR mechanisms embedded in the training and skills development platform(s),

(7) Third party platforms of TLCEODRI, etc.

In short, the ODR process of TLCEODRI can be initiated by simple exchange of e-mails to use of dedicated dispute resolution platforms. Early registration to our discussion forum and other platforms is highly recommended for various stakeholders like e-commerce websites and companies.

Techno Legal Centre of Excellence for Online Dispute Resolution (ODR) in India (TLCEODRI) has been managing techno legal issues of ODR since 2012. However, ODR related issues were managed by us in one form  or other since 2005. We have now rejuvenated our efforts in this regard and launched a full fledged ODR platform to cater the needs and requirements of national and international stakeholders.

Technology can be used to resolve disputes among the parties even if they are located in different countries. Online dispute resolution (ODR) in India is also seen as a viable option to resolve disputes without litigation. ODR can be used for cross border e-commerce and technology transactions disputes that require urgent and cost effective resolutions.

Further, corporate disputes in India could also be resolved using ADR/ODR techniques. India has recently adopted the Digital India and Internet of Things (IoT) policies that would use technology to provide public services. This may result in growing use of e-courts in India and use of ODR in India in the near future.
 We at Perry4Law Organisation  and   believe that use of ODR and e-courts at national level are bound to happen though not at the same pace and level as is happening at the international level.
